Court strikes Out Sha’aban’s Case Against Uba Sani

A Federal High Court sitting in Kaduna state, has struck out a case filed against the gubernatorial candidate of the ruling All Progressives Congress (APC), Senator Uba Sani.

In a judgement on Friday; 4th November, 2022, the presiding Judge, Justice Mohammed Garba Umar, averred that the case was struck out for lack of jurisdiction.

The Judge also explained that the case contravened the provision of the National Judicial Council policy direction.

However, the judgement came after two adjournments for the ruling on the case seeking nullification of Sen. Uba Sani as the authentic candidate of APC in Kaduna.

Speaking to the media shortly after the judgement, the lead counsel to the plaintiff, John S Mshellia, said that in a contest, a case must always end either rightly or wrongly.

According to him, he said that the reason the judge gave for striking out the case was that the case should have been filed in Abuja, and then transferred to Kaduna.

Though, Mshellia said that the judge has given them a sense of direction on what to do next.

In a reaction to the court judgement, the APC Northwest Zonal publicity secretary, Malam Musa Mada, assured party faithfuls as well as teeming supporters that the party still remains one indivisible family determined to salvage the plight of Nigerians.

Mada asserted this while addressing newsmen in Kaduna on Friday.

He explained further that the party is working tirelessly to ensure unity in the party adding, “recall that in our last press conference, we mentioned that we had resolved 25 out of 36 cases arising from the party’s pre-primary election some of which were inter-party issues.

“We are still not relenting in ensuring that other pending cases are settled out of court, using the reconciliation mechanism,” Mada added.

He, however, urged all stakeholders as well as party faithfuls to shelve any form of bitterness and instead, maintain optimism of the party’s victory at the general elections at all levels.
